Market Court issues decision on grid protection system linked with production at Olkiluoto 3

The Finnish Market Court has today issued a decision on the appeals made by Teollisuuden Voima Oyj (TVO) and the national grid company Fingrid Oyj (Fingrid). The decision of the Market Court deviates in part from the decision of the Energy Authority.

The Energy Authority issued the decision on the national grid protection linked with OL3 production in January 2024. According to the decision, grid protection is a specific protection system of the grid operator and under the responsibility of the national grid company Fingrid Oyj.

Today, the Market Court issued a decision on the appeals of TVO and Fingrid and amended the decision of the Energy Authority in some parts. In its decision, the Market Court found, contrary to the Energy Authority's decision, that Fingrid had not unjustifiably transferred its obligations related to the transmission grid protection system to Teollisuuden Voima Oyj (TVO) The Market Court rejected TVO's appeal.

- The decision of the Market Court was a disappointment. TVO will now carefully review the reasoning of the decision and consider possible further action. In TVO’s view, the responsibility for the development and protection of the grid rests with Fingrid, as stated by the Energy Authority in their decision in January 2024, says TVO’s Ulla-Maija Moisio, Senior Vice President, Legal Affairs.

The Market Court is still reviewing the decision of the Energy Authority regarding the bases of the charges related to grid protection. TVO and Fingrid have appealed against this decision.

On grid protection

In the view of national grid company Fingrid, the national grid is not currently ready for full-power operation (abt. 1600 MW) at OL3. The opinion of Fingrid is that with production exceeding the 1,300 MW power output level, the grid requires protection which will ensure the operability of the grid also in case abnormal conditions occur. At present, protection is implemented by reducing the consumption of specified industry consumers as well as by utilising e.g., battery storage plants.

Fingrid has in recent months on several occasions required that the power output of OL3 be reduced, because the protection operated by Fingrid has not been fully available. This may occur, for example, when an industrial business included in the protection system is undergoing a maintenance outage.
